Louisiana Man Wins Naming Contest; Tree-Free Chardonnay Hits the Shelves June 2010
Fans Can Join [yellow tail] in their First Virtual Tasting to Kick off Tree-Free on June 22 and July 15

White Plains, NY, June 21, 2010 — What is [yellow tail] Tree-Free Chardonnay? Ask Jared Kendall of Baton Rouge, Louisiana. He's the [yellow tail] wine fan who named it! Kendall entered the brand's online naming contest in November 2009 and won with his creative, quirky name – Tree-Free Chardonnay. [yellow tail] wine's newest addition, an un-oaked Chardonnay, will be available nationwide starting this month.

[yellow tail]'s Tree-Free Chardonnay differs from their traditional Chardonnay because it is not aged in oak (hence the name, get it?). This wine delivers a lighter, crisper flavor profile with hints of citrus, grapefruit, and lime. The new varietal will retail at $7.99 and joins four other white wine varietals in the [yellow tail] portfolio: Chardonnay, Pinot Grigio, Riesling, and Sauvignon Blanc.

The idea for the contest was simple - [yellow tail] wine needed some extra help! After creating a new chardonnay varietal, the [yellow tail] team was stuck on the name. They turned to their loyal consumer following and put a call out for suggestions on their Facebook page and web site this past winter. The contest received more than 700 entries in a mere eleven days, but Kendall's submission of Tree-Free really stood out for its clever way of saying that no oak is used in the wine making process.

"We knew we had something special with this unique tasting Chardonnay, but we needed to uncork another asset -- the creativity and passion of our fans," said Isabelle McDonnell, Director of Marketing for [yellow tail] wines. "We're launching an innovative varietal that tastes as unique as it sounds; its light, fresh taste will appeal to those that may have forgotten about Chardonnay as a wine option."

Kendall was awarded the first case of Tree-Free Chardonnay for his creative prowess. The wine traveled from Casella wineries in Australia and arrived at the doorstep of his Baton Rouge home at the end of May. He was able to sample the sweet taste of victory amongst friends and family.

"[yellow tail] has always seemed like it has a great sense of humor , so it makes sense they'd use such a fun way to name their next wine," said Jared Kendall, creator of the 'Tree-Free' name. "When I saw the chance to suggest an inventive name for the brand, I was inspired to submit this name suggestion."

[yellow tail] will continue to engage consumers surrounding Tree-Free Chardonnay by hosting two virtual wine tastings open to all adults 21 and over. Utilizing social media, [yellow tail] invites fans to give real time reviews online by uncorking a bottle on Tuesday, June 22 and Thursday, July 15 between 3pm and 7pm EST and posting their thoughts. During this time, fans can participate by typing their reviews directly on DiscoverYellowTail.com or via Twitter using the #TreeFree hash tag. [yellow tail] will be participating as well, offering sampling tips, pairings, and other treats for participants. The entire stream of conversation will be viewable on DiscoverYellowTail.com.

In the end, every participant in the online naming contest received an honor from [yellow tail]. The brand was so intrigued and entertained by the additional creative suggestions that they provided all 700+ contestants with customized wine labels featuring their own unique wine names. (Ensuring that all contestants can buy bottles of Tree-Free Chardonnay and secretly sticker over it with their own dream name – whether they pass the name off as their own or not is up to them!)

NO PURCHASE NECESSARY. TO PARTICIPATE, ALL ENTRANTS MUST BE CURRENT LEGAL U.S. RESIDENTS RESIDING IN ANY OF THE 50 UNITED STATES or WASHINGTON DC, 21 YEARS OF AGE OR OLDER. VOID in CA AND WHERE PROHIBITED. TO ENTER THE CONTEST: On a 3" x 5" card, hand print your complete name, street address (no P.O. boxes), city, state, zip code, daytime telephone number with area code, signature and date of birth and mail in an envelope to: W.J. Deutsch & Sons, Ltd. "[yellow tail] Fall 2008" Contest, P.O. Box 3023, Rogers, MN 55374-3023. With your 3" x 5" card, submit your original and unpublished photo and essay explaining how [yellow tail]® helped put your tailgating party on a whole new playing field. Both photo and essay must be submitted in order to be eligible for the Contest. Official Entry Forms must be legible and completed in full to be valid. Entries must be postmarked by 10/31/08 and received by 11/5/08. No mass or mechanically reproduced entries will be allowed. Sponsor not responsible for lost, late, stolen, misdirected, torn, altered, illegible or postage-due entries or entries with incomplete information. Contestant must have written permission from all persons featured in the photograph and the owners of all private property and any trademarks appearing in the photograph in order to post said photograph and grant permission to Sponsor herein to display such photograph on the Web site. Under no circumstances, should any person under the age of 21 be included in any photographs. Essay submissions may not exceed 200 words. Limit one (1) entry per person, household or address. All eligible contest participants will each receive one (1) [yellow tail]-branded bandana. Bandanas will be delivered 8-10 weeks after the end date of the Contest.

Contestants each warrant that their entry is original, does not violate any law, regulation or right of any third party, including, but not limited to copyright, rights of publicity and/or privacy, that the entry is their own work, and that Contestant has followed the full Official Rules of this Contest. Eligible entries received will be reviewed by Sponsor for compliance with the full Official Rules and entry parameters set forth herein and, at Sponsor's sole discretion. The Sponsor reserves the right in its sole discretion to decide if an entry is inappropriate for posting and may disqualify any entry at any time in the event it is determined, in the Sponsor's sole discretion, that the entry is not appropriate for any reason. Any entry that prompts a legal challenge or any reasonable complaint, in Sponsor's sole discretion, will be removed and disqualified and any physical or monetary prize awarded in connection with any such submission will be forfeited. Once submitted, an entry may not be changed, altered or modified by Contestant. Sponsor reserves the right to delete any entry in its entirety.

Sponsor not responsible for blurred, out of focus, dark or unclear photographs. By entering this Contest, entrants accept and agree to be bound by these full Official Rules and the decisions of the judges, which shall be final, binding and conclusive on all matters. All entries become the exclusive property of the Sponsor and will not be returned or acknowledged. Contest Entry Period ends 10/31/08.

JUDGING: Official Judging: Each photograph and essay will be judged on or about 12/1/08 by a judging panel selected by Sponsor, in its sole discretion, on the following criteria: Use of [yellow tail] name and logo in photograph (30%), Creativity of tailgating event (30%), Written expression of essay (30%) and Suitability for use in advertising (10%).

The judging panel will disqualify professional and/or previously published photographs and images that the judging panel, in its sole discretion, believes to be inappropriate for any reason. Based on the decisions of the judges and the judging scores as determined by the judges, which are final, the prizes listed below will be awarded. In case of a tie, the entry with the highest score for use of the [yellow tail] name and logo will be declared the winner. In the event that a tie still remains, the entry with the highest score for Creativity of tailgating event will be declared the winner. In the event a tie still remains, the entry with the highest score for Written expression of essay will be declared the winner. In the event a tie still remains, the entry with the highest score for suitability for use in advertising will be declared the winner. In the event not enough qualified entries are received, Sponsor need not award more prizes than entries received. Fulfillment agent will attempt to notify potential Grand Prize winner by telephone and First Prize winners will be contacted by mail on or about 12/8/08. Potential Grand Prize winner will be notified by telephone at the daytime number listed on his/her Official Entry Form and First Prize winner will be notified by mail at the address listed on his/her Official Entry Form. If, after two (2) attempts, contact has not been made, prize will be forfeited and an alternate winner will be selected. Fulfillment agent must reach potential winner; messages will not be left. Prizes will be delivered 6 to 8 weeks after winner verification.

PRIZES: GRAND PRIZE (1): One (1) Grand Prize winner and nine (9) guests will receive a football-themed party (date, location and venue to be selected by Sponsor), ground transportation from a central location and $200 spending money. (Total Approximate Retail Value (ARV) of Grand Prize: $10,000.00) WASHINGTON RESIDENTS: Under state law, the football-themed party portion of the Grand Prize must take place in a venue that does NOT hold a liquor license. All other expenses not specifically stated herein are the sole responsibility of Grand Prize winner and guests. All guests of Grand Prize winner must be 21 years of age or older. While no part of this prize includes alcoholic beverages, alcoholic beverage may otherwise be available. Winner and guests are solely responsible for their own conduct while accepting the Prize including without limitation the consumption of alcoholic beverages, if any. Fulfillment agent will notify Grand Prize winner of party details by 2/1/08. Grand Prize must be fulfilled by 12/31/09. Sponsor is not responsible for winner's or guests' inability to participate in any prize due to physical or other restrictions and Sponsor is not responsible for any injury, whatsoever, which may occur. FIRST PRIZES (5): Five (5) First Prize winners will each receive one (1) Flat-Screen TV (size, make and model to be selected by Sponsor). Submission of an entry grants Sponsor the right to modify, edit, adapt, alter, and publish and/or use the photograph or essay or any idea depicted in the photograph or essay in any way, in any and all media, without limitation and without consideration or payment to the entrant. Grand Prize winner and guests will be required to execute an Affidavit of Eligibility/Originality and Publicity/Liability Release. First Prize winners will be required to sign Affidavit of Eligibility/Originality and Publicity/Liability Release. All requested documentation must be returned within seven (7) days from the date appearing on the letter of notification or prize will be forfeited. In the event that any potential winner is unable to accept any prize, fails to complete required documentation or cannot fully abide by the prize conditions stated herein, a disqualification will result. In said case, the Contestant with the next highest judged score shall be declared the Grand Prize or First Prize winner in lieu of the prize previously slated for such winner (for example, if the potential Grand Prize winner is disqualified, the First Prize winner will be declared the Grand Prize winner, in lieu of First Prize.)

GENERAL: By participating in this Contest, each entrant agrees to: (a) be bound by these Official Rules and decisions of Sponsor and judges, which shall be final, binding and conclusive in all respects and in all matters; (b) release, discharge, indemnify and agree to hold harmless Sponsor and each of its parents, subsidiaries and related companies, advertising and promotion agencies and all of their respective officers, directors, employees, representatives and agents ("Designated Parties") from any liability or responsibility whatsoever for any claims, costs, injuries, losses or damages of any kind (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to, loss of, or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light), arising out of, or in connection with, the Contest or from their acceptance, possession, use or misuse of any prize, or participation in the Contest or any Contest-related activity; (c) grant the Sponsor all rights of ownership, reproduction and use of Contest entries for any purpose whatsoever without consideration, compensation or further permission, including but not limited to an irrevocable and perpetual, royalty-free, worldwide right, in all media (now known or later developed) to use, publish, alter or otherwise exploit Contest entries without notice, review or approval; and (d) the announcement/use of name, Contest entry (if any), voice, image and/or likeness for trade, advertising, publicity and promotional purposes without consideration or compensation (unless prohibited by law) by the Sponsor in all media now known or hereafter discovered, worldwide, including but not limited to the Internet, without notice, review or approval and agrees to execute specific consent to such use if asked to do so. In no event shall Sponsor be liable for: (a) telephone, electronic, hardware or software program, network, Internet or computer malfunction, technical errors or by any human error which may occur in the processing of the Contest, votes or the incorrect or inaccurate capture of Contest entries or other information, or the failure to capture any such information; (b) failed, incomplete, garbled, corrupted or delayed computer transmissions; (c) lost, late, misdirected, mutilated, incomplete or illegible Contest entries, votes or voter registration information; or (d) any condition caused by events that may cause the Contest to be disrupted or corrupted. Sponsor reserves the right in its sole discretion, to cancel or suspend the Contest, or any portion thereof, should computer hardware or software malfunctions (such as, but not limited to, viruses, bugs, worms, tampering, unauthorized intervention, fraud, technical failures) or any other causes corrupt or hamper the administration, security or proper play of the Contest, and select the winners for the Contest from entries received prior to the action taken, or in such other manner as deemed fair and appropriate by Sponsor, in its sole discretion.

RELEASE OF LIABILITY: All entrants release Sponsor, D.L. Ryan Companies, Ltd., and each of their respective parents, affiliates, subsidiaries, officers, directors, agents, employees and all others associated with the development and execution of this contest from any and all liability with respect to, or in any way arising from, this Contest and/or use of the prizes, including liability for personal injury or death.
